Dems in the Senate passed a resolution in 1960 against election year Supreme Court appointments
 
Whether you agree with his opinions or not, he was a brilliant man.

He spoke at my school about a decade ago. Some liberal professors refused to even show up to hear him speak. The thing you need to understand about Scalia, is he tried not to let his personal feelings influence his decisions, but instead went by what he considered to be the letter of the Constitution. Many other judges prefer to instead interpret the Constitution in a way to determine what our founding fathers would have meant if they had drafted the document in modern times (essentially the Constitution is a living document). These judges often infer that the founders would mean whatever a reasonable person today would mean, which often completely skews the true meaning of the Constitution, and usually matches the judges feelings as to what is reasonable.

Scalia felt that if the Constitution, as drafted, provided a protection, then he would stand up for it. If it was silent, he said so. If something that is not protected by the founding fathers becomes so important that it needs protection, then we should amend the Constitution to provide those protections, not just interpret the document to mean something it never did. Scalia's view was that if we don't hold to the document's meaning, then we have no bedrock for our Country to stand on.

If you disagree with his opinions, blame the Constitution, and Congress for not making the needed changes to the Constitution to bring it in line with modern times. Do not blame the Judge who's duty was to interpret the meaning of the law.
 
I agree with Siro that we need a centrist.

I am glad that the appointment process is becoming more politicized in the congress. Presidents have politicized the actual court by appointing judges further to the left and right than SC justices probably should be. Congressional gridlock hopefully will force the appointment of a centrist.

Just saying your post really adds nothing to the discussion, and doesn't make me feel any more sorry for his passing. Who gives a **** if he was "brilliant" if a dude is a piece of ****.

Neither Bush appointment was as right as possible. Roberts, specifically, is just right of center. And it isn't really taking the high road. We're better served by a centrist Justice who would make judgements based on a careful analysis of all of the facts, instead of a default ideological position.

The Dems are generally accepted as the party that politicized the SCOTUS in the first place. The Dems won't be doing the confirming because they don't control the Senate so I'm not sure what you are talking about. When you say Dems do you mean Obama? If you are forced to do something(Obama appoint a more centrist Justice)that isn't taking the high road.

Congress is a very *** for tat kinda institution. The Dems will surely return the favor for any future GOP president(it may be a while).

2. The longest they've delayed was about 4 months. But there is no limit to how long they can delay, and they can stall until next president is sworn in.

2. Yes. The Supreme Court generally deals with constitutional questions. They take on cases to determine whether a law is/isn't constitutional.

Another honest and propably silly question: why was the topic created in this forum, airliners.net forum and probably some other forum too (in General Discussion)? Would an average citizen whether he/she is NBA fan, aviation fan etc notice/feel in general who exactly are the members? It seems to me (based on the heated conversation here) that even friends can be enemies, if wrong person is elected to the Supreme Court. Specially for me is strange that some persons are quite happy that Scalia is dead. For comparison, i am not fan of a Vladimir Putin, but i would not dance in joy if he would die suddenly.

The Supreme Court has a HUGE impact on the lives of every day Americans, and the long serving members are pretty much household names. Every major law eventually makes its way to the Supreme Court. They are the reason gay marriage is now legal nationwide, for example.

While you might not be happy if Putin died, many would be. You don't have to be an American to understand this. Being a fellow human is sufficient.

What makes you think he was a piece of **** btw? I'm interested in why you think that. Because of his stance on the 2nd amendment? Gay rights? Abortion?
