80 year old man returns home to find 2 people (man and woman) robbing his home. He has been robbed 3 time sbefore at that home. The man and woman assault him and beat him to the ground and break his collar bone in the process. The homeowner gets up and gets to a gun and opens fire. The burglers run thru the garage and into the adjacent alley. The homeowner follows them out and shoots the woman twice in the back and kills her. Homeowner claims that the woman said "don't shoot me, im pregnant". No confirmation of that. The man robbing him got away but got caught by police. He is facing a murder charge.

So, do you agree with the murder charge on the male burgler?
Should the home owner face criminal charges (possibly murder)?

Personally I think the homeowner could be looking at legal trouble due to where he shot them.
 
Yes, unfortunately for the homeowner, the robbers were fleeing, so he was no longer in threat of death or further bodily harm. Takes away self defense.
 
Home owner in the wrong, imo. Should not have taken law into his own hands.

Once burglars left he was no longer in danger. He even admitted the woman said dont shoot!!!
 
What if they were going to come back to finish the job?
 
After being violently assaulted and receiving a broken collar-bone, I can't imagine it's easy to turn off that switch in your brain suggesting that you protect yourself at all costs. I would imagine while beating violently beaten he was worried they would kill him.

My thought would be that if you catch burglars in your home and they immediately run away, you can't shoot and kill them. They pose very little threat during the incident. Once they substantially attack you, you should have a right to retaliate during the incident regardless of their actions at that point.

May be he thought he's 80, he's been hit 2-3 times now, what the heck I'm gonna shoot them mother****ers one of these days.


Also it's pretty unlikely the jury would find an 80 year old man guilty of this anyway, so he knows the DA would probably be going after the burglar.

If I were on the Jury, I would not convict him, even though he broke the law. Sometimes people get what they deserve.
