Homeowner forecloses on Bank of America

I thought this story might interest many of you. The homeowner bought his home for cash. There was no loan. Bank of America improperly tried to foreclose on him despite the lack of a loan. The homeowner won in court and the bank was ordered to pay the man's legal fees. The bank did not pay and avoided any communications. The man and his lawyer decided to foreclose on Bank of America to get their judgement with the assistance of police and had the office pad locked and started removing equipment. The homeowner was handed a check about an hour later.

The story sounds too crazy to be true; but I believe it because something similair happened to my brother with B of A. My brother has a mortgage with B of A and refinanced with them last year for a lower rate. He completed all the necessary closing documents and starting making payments on the new mortgage and 2 months later he received a foreclosure notice on his original mortgage.

What happened next was a complete nightmare. NO ONE at B of A would help him. The people at B of A that he refinanced with (who were in Arizona) told him it was out of their hands. The people who were sending him foreclosure notices (who were in North Carolina) told him they had no record of him refinancing and to pay up or get out. It actually got to the point where a lawyer came my brother's house and asked him when he planned on "vacating the premises". Like this guy, my brother had to go to court to get it straightened out and he's still trying to get his legal fees reimbursed.

The problem is B of A is way too ****ing big running on multiple platforms in multiple parts of the country. But apparently it's more than that - my brother's lawyer told him that it just so happens that these types of stories most often take place in areas of the country that have desireable markets for real estate. My guess is that is not a coincidence.
 
So let me get this straight... Capitalist greedy banks only look out for themselves trying to screw over everyone else? Gee, what a surprise!

Glad this guy kicked their asses.

Of course, I fully expect the banks to come crawling back to all of us in a few years asking for a few more trillion to bail them out.

Unbelievable. Your brother should sue not only for the legal fees but for the personal time and worries he wasted.

This. I'd have been email bombing every single executive in the company threatening litigation unless the situation resolved itself immediately. If said warning was not sufficient, I'd go for the throat.

Don't get me wrong. I hate frivolous lawsuits but the **** corporate America gets away with is downright disgusting and examples need to be made to cut back on such practices.
