Because OSHA itself is likely unconstitutional as detailed by Cass Sunstein who was the former Administrator of the White House Office of Information and Regulatory Affairs under the Obama administration.
The Occupational Safety and Health Act is overly broad and the only thing that had kept OSHA in existence this long is that OSHA has been careful not to step over constitutional lines. This executive order from the President with no input from the Legislative Branch is over that line. I predict that Chief Justice Roberts will tie himself inside out trying to keep OSHA alive as an agency but there is no way that executive order doesn't get struck down.
If SCOTUS refuses the case then the wager is off but they won't. This question over OSHA itself is too big for them not to weigh in. The bet is also off if no fine is ever levied.

It has been my experience that the bulk of those not wanting the covid vaccine are not anti-vaxers but rather do not think covid is a big enough threat for a vaccine or feel the vaccie was rushed and not thoughrouly vetted for safety. Particularly the mRNA ones.

I am and have been a huge advocate for the vaccine. I am vaccinated with the mRNA vaccines as is everyone in my family. My kid is too young still but he has all other vaccines and gets the flu vaccine once per year.
I loathe the vaccine mandates. The issue I have is in abuse of power bordering on dictatorship. Our government is set up with coequal branches of government, each with separate enumerated powers. There are also independent levels of government with local, state, and federal scopes of power. Those advocating for Biden's ability to order vaccine mandates are trashing all of those limitations. Their argument appears to be that if any part of the government has the power to do a thing then Biden has that power. That is not how our government is supposed to work. That is how a dictatorship works.
Joe Biden did not get elected to be Dictator. Just because local school boards and state legislatures may have a power does not mean the head of the executive branch of the federal government does. No past US President executive ordered MMR vaccine mandates. The problem isn't the mRNA vaccine but instead the gross abuse of power.
I suspect that when this gets to the SC and they reverse the mandate, there will be an even greater cry to pack the court.

No. They are literally being released and even flown into our cities infected with covid and unvaccinated.

There has to be a ruling one way or the other by the SC. If it is stuck down I win. If it is kept in place you win. If the order gets rewritten, dropped, or unenforced then neither of us win. It has to be a decision on the current, as-written executive order one way or the other by a majority of the Supreme Court to count.
