HUNTSVILLE, Alabama -- The boy accused of raping a female student in a Sparkman Middle School bathroom in January 2010 committed repeated sexual offenses even after the incident sent him to the district's alternative school.

Court records indicate the 14-year-old girl was raped after teacher's aide June Simpson told her to go into a boys' restroom with the 16-year-old boy, who had reportedly been harassing several girls and asking them to have sex with him. Both he and the victim were special needs students.

Simpson told the girl that the school administration could punish him if they could "catch him in the act." When neither Simpson nor any other school official followed the teens into the bathroom immediately, the girl was sodomized.

Later in the article they release the school record of the rapist. He has quite the rap sheet. How this monster was allowed to stay in the public education system is beyond me.

I've also read from a local paper there that every school year the admin would shred his record and give him a "clean slate" for the next school year. Huh??? Why? Can someone smarter than me explain?

Is it really that hard to get rid of garbage? Has NCLB made it impossible to kick out students with special needs (but who are complete monsters)? Where the hell are his parents? How the hell can you live with yourself as an educator and principal?

This story just makes me so angry!

uh, the incidents date back to 2009 and 2010, nothing in the article is more recent than January 2010, over 4-1/2 years ago

and why blame the entire education system and NCLB for one school's administration dropping the ball - - you've gone over the edge with this one

The U.S. Department of Justice argues administrators at Sparkman Middle School near Huntsville knew the boy was dangerous and showed "deliberate indifference."

A few specific individuals at the school definitely failed in their job but it doesn't seem to go beyond that.

...The Justice Department argued that the school shredded student discipline records each year, required officials to witness sexual harassment in order to take action, diminished serious incidents in its record-keeping, and had been "closing its eyes" to evident dangers.

The Justice Department argues the girl's guardian should be allowed to sue under Title IX. "It makes a recipient of federal funds, here, the school district, 'liable for [its] deliberate indifference to known acts of peer sexual harassment.'"

Medical evidence confirmed anal tearing and bruising. The girl withdrew from school and moved to another state.

The federal brief argues school officials minimized the incident, listing it in the boy's extensive record as "inappropriate touching." The federal attorneys note one assistant principal, despite seeing photos of the injuries, contended school officials could not know if the girl had consented...

The teacher sent a special needs girl into a boy's restroom? That teacher needs to do time.
