alright folks. Long road, lotsa talk radio. I'm here to report the news ya'll missed dawdling in the mainstream duckpond.

One week ago I could see the alarm from conservatives about the dark horse nominee-to-be.

Haven't I told you before that Trump is here to make the best deals he can. The nomination of Cavenaugh was in the bag, really, before Kennedy announced his retirement. It's why he chose to retire, knowing he had someone who would do a damn good job standing in for basically his world view for decades to come.

Cavenaugh has deep Bush connections, and is a loyal CFR partisan/worker bee. McCain will have himself Life-flighted to DC because he will be so damn proud to vote for him. With this move, Trump is showing real genius for unifying the Republicans ahead of the coming election while scattering his rabid critics to the four winds.

Of course, I really know nothing, but imo..... in my deepest fantastic contortions of the known universe..... Cavenaugh is everything I ever criticized Colton for. Sensible, solid, intelligent, convinced if not convicted by actual beliefs.

I, on the other hand, am a mere dreamer with a utopian vision of my own, of a world where I can wander about on my own instance doing whatever I care to do, comfortable in whatever cave I can find at the end of the day, content with whatever fuel, fire, skins, meat or bark broth afforded by resources at hand.

All in all, I'm not so different from the elites with their secret mansions in the backwoods, except I pay no rent and well, my fair share of taxes.

WTF are you talking about? This was a safe move after the Supreme Court's recent ruling in the Lucia case. Otherwise, the Lucia decision potentially compromise all ALJ decisions and subjects them to being overturned under the premise that they should have been political appointees and not hired employees. Unless you want all ALJ decisions to be uncertain.

Hiring through OPM was a bad structure anyway.

Hiring through OPM was a bad structure anyway.

Hiring through the OPM gives us a far better chance at impartiality. By allowing them to be appointed political positions you’re opening up a can of worms for corruption. What’s stopping a big industry from donating into someone’s campaign coffers to buy up a position that’s supposed to regulate and render judgements in that industry? Why are we permitting foxes guarding the henhouse?
 
In all honesty if trump were a better politican, he’d nominate a moderate. He’d probably take out a lot of momentum from the blue wave this midterm and go a long way to restoring bi-partisan action in the senate. Instead, he’s just going to pile on and continue to polarize Americans.

Instead, K will barely be confirmed as both parties with few exceptions vote the party line. Democrats are a few senators short and Doug jones from Alabama and the one from Missouri are particularly vulnerable (id he surprised if they didn’t flip for republicans). If the nomination is secure I could see someone like Collins voting against it so she can claim to her state of Maine that she’s not lock step in line with the party.
Appointing two SC Justices is the payoff for electing and supporting Trump. You're worried about what it'll do to energize Democrats? This is the Republican wet dream. They can look at this and imagine if Hillary had been able to appoint two Justices and the liberal nightmare their nation would become. This is why Trump got elected and why he hasn't been abandoned by established Republicans. This energizes his base more than it energizes Democrat voters. This is what "winning" looks like.

You do not know what you are talking about. Having gone through the OPM process, and then been on committees that hired people through it, I can tell you it is antiquated and has poor screening. It takes six months to process, and OPM is HORRIBLE about opening the ALJ process, even though agencies pay for them to do so, which results in backlogs of cases and overworked ALJs. The government has many inefficiencies, and OPM is at the top of the list.

Prior to this Executive Order, the agencies still choose who to hire, they just pick from the pool of OPM candidates that have been screened by OPM employees with very little qualifications (gs-5 iirc) that look only for keywords in applications. A very poor screening process. And this is the process most Govt employees must go through.

All the EO does is allow agencies to hire more easily and it will ensure they get a better flow of ALJ candidates, which is one area where the Govt is short on employees. And again, most importantly, it will ensure ALJ decisions going forward can't be overturned due to the holding in Lucia.

Any President would have been put in a position to make this same move after Lucia.

Administrative Law Judges are anathema to the separation of powers in this country. Sure, it's efficient. It allows the courts to be not only judge and jury, but to write the policies and enforce them. In short, the idea is absolute Fascism at it's finest.
It's like the Lubyanka and the guys who filled the cattle cars for Auschwitz. Modern Management has never had it so good.

I share Thillers concerns about concentrating the management. This is the most pervasive and systematic attack on human liberty ever dreamed of in the parlours of the elites.

Even having a local bar club.... a pun there, folks.... decision making by professionals on a local level.... is better than having even a maverick iconoclast like Trump making all the decisions..... because....

the next thing you know, the term limits on the Presidency will be "Transformed in America" to be applicable only to consecutive terms, and Obama will step up to finish the job for Management. Hell, who knows, maybe they've already got their Hillary manikin robotized and online for the next election.
