A hypothetical I'm sure nobody wants to entertain (I'm sure it won't happen, and I don't want to get bogged down by the mechanics of how it might be be detected, but just curious for the sake of argument):

If the penalty for being investigated and found "guilty" of tanking was losing the chance to move into top-4 in the draft, but draft positioning otherwise remains the same, would that measurably discourage tanking? Would that affect what we're doing this season?
 
We need to get start getting grimy again. Fortunately we’re in a decent spot with our two best players barely missing any games.

MPJ sits every back-to-back. We have Wizards reporters stating they doubt Trae plays 10 games for them this year.

What are we worried about?

The Jazz should sue, then. The Jazz are not the worst offenders, and it’s not particularly close.

I also don’t think that’s a hypothetical. Completely 1000% unprecedented.
