A draft of an upcoming Supreme Court decision was leaked to Politico. Roe v. Wade is being struck down. There are three things about this that I find interesting, and the “right” of women to snuff out a human life while remaining free from any legal consequence for that act is the least interesting.

Interesting thing #1:
Roe v. Wade was the most egregious power grab by a branch of our government in the last century. There is nothing in the constitution about abortion and the 10th amendment specifically says that if it ain’t in the constitution then the federal government, including the Supreme Court, has no power in the matter. That it was the Supreme Court that did it makes it even worse because they are not lawmakers and they are not elected. For all those who have recently decried that “our democracy is in danger”, you should be extremely happy for this decision. If you are not then you are a hypocrite who has been revealed as willing to say anything you think gives you power to enact things you want.

The danger of doing this cannot be understated and could potentially lead to one or more the justices being killed by an unhinged zealot. The person or persons who leaked this draft must be identified and prosecuted to the fullest extent of the law.

Roe v. Wade may being going down and that may restrict abortion in some states but that doesn’t ban abortion. States cannot prevent their people from leaving and other states have already vowed to uphold a woman’s ability to snuff out a human life while remaining free from any legal consequences. Young women may need to travel a bit farther but otherwise nothing but some convenience is being taken from them.

Reproductive rights are just another way for men to exert power and control over women. If you own nothing in life you own your own body and what goes in and out of it. I suppose if women wanted that sort of freedom they should have been born as men yeah? There is nothing to celebrate in this, it is a defeat for men and women all over your country.
 
I believe that women should be able to choose, although I am personally pro-life and will advocate for life but still give people the right to choose. It is a very complicated issue. The out of state thing may truly preclude many poor people from getting a legal abortion as they have no means to travel.

That said, I've always had issue with cases that seem to pull rights out of the air that aren't part of the constitution, and applied them to the states through the 14th amendment.

Roe could still be codified into federal law.
 
I believe that women should be able to choose, although I am personally pro-life and will advocate for life but still give people the right to choose. It is a very complicated issue. Not really that complicated, its a personal choice and that should be the end of it. I remember being at church with my Nonna when I was a kid, the priest was banging on about abortion, maybe he'd knocked up one of the nuns i dunno. When we walked out my Nonna turned to me and said what does he know about raising a family. Smart woman my Nonna.

The argument that one's opinion doesn't count because you aren't X is just plain fallacy. Continue to have your simplistic view. I'm not going to argue abortion on JF, lol. Just reiterate that I don't like it when courts make up law in the constitution that does not exist.

I have no issue with Roe being codified into federal law. That is what should have been done in the first place. Since Marbury v. Madison we have allowed the Sup. Ct. to have too much power. A savvy court pushed that through and it changed jurisprudence in a negative way IMO.

Most High or Supreme courts have that power, there is no perfect solution to it, the banks case here established a constitutional right to private property despite it not being mentioned at all in our constitution. The only two medical decisions I can think of where there is a fight over the patients right to determine the outcome of their treatment both happen to related directly to religious dogma. Abortion and euthanasia, deciding to have a family or end your own life are the most personal of choices and have nothing to do with the state, religion or anybody else other than the individual making that choice. Its a basic freedom, not simply a freedom of choice but the freedom to not have the value beliefs of others imposed on yourself.
 
Isn't it odd that we can tell women what to do with their bodies and force them to carry children born of rape, incest, etc., but god help those same individuals who require people to get a vaccine in an arm echoing 'my body, my right'?

Let's just call it what it is: a push to continue to place religious Christian beliefs onto others regardless if they believe in those virtues or not.

And any ruling will not eliminate abortions - those that want or need them will simply go to states that permit them and/or take unsafe measures that will put their own lives in danger.

It can’t be codified because of the Senate and the filibuster. Do you support blowing the filibuster?

I don’t know if you’ve noticed, but nothing passes the Senate outside of judges and spending bills under reconciliation. Which suits the GOP fine since they don’t actually care about passing legislation that requires beating the threshold of the filibuster. They’re fine merely passing tax cuts for their richest donors and confirming judges, both of which just need simple majorities.

So if we are to codify abortion, it would require a simple majority since you’ll never get 60 Senators from an increasingly extremist GOP and their base. The media environment and GOP base won’t permit Senators from red states to pass abortion rights. Hell, you won’t find 10 Senators to agree that the sky is blue because agreeing with Democrats over anything means being blasted by Fox News and primaried.

Lastly, once codified what’s stopping the SCOTUS from killing it, as they did with the Voting Rights Act?

You skipped over the 9th Amendment, the one that says that people have rights beyond what have been enumerated in the Bill of Rights.

Every pregnancy will need to be investigated. If you or someone you know becomes pregnant and doesn’t give birth 9 Months later, they’ll need to be investigated. Men and women both, will face economic, social, and criminal scrutiny (talk about big government and cancel culture).

If you’re suspected of getting an abortion? You may find yourself in prison for years.

If you are found to help a woman get an abortion in other state? You can be fined and imprisoned.

If you report a woman suspected for getting an abortion? You may be rewarded $10,000 dollars.

All 3 of these issues are codified by Texas law right now.

And that’s just the start. You’re going to see increasing scrutiny for online purchases. If a woman purchases medication to induce an abortion, you’ll see her credit card and online purchases under scrutiny. Travel will be investigated. Communications will need to be searched. If she has a miscarriage, she’ll need to be investigated. Even if she isn’t found guilty, the social and economic stain remains.

Don’t like abortion? Teach comprehensive sex education and provide free and easy to access contraception. But Republicans won’t even do that. So it’s obvious that this isn’t about life or god or families. This is about control. It’s about making women second class citizens. Just as this scotus will soon do to the LGBT community.

Is this really the society we want to live in?

It’s about birth control, voting rights, and the LGBT community. The scotus and GOP have proven to be hostile towards these things.

This ****ing isn’t going to ****ing end with Roe folks. They’re going to target birth control and gay marriage next. Collective bargaining rights and the EPA after that. Interracial marriage and brown v board aren’t too far behind.

If you care about the rights and freedoms we currently enjoy, you should be angry and upset right now. So ****ing angry that you vote every single Republican out of office this fall with democrats. And keep voting them out until they learn to leave these things alone.

Keep the House in Democratic hands and give them a few more Democratic senators so they can codify abortion, gay marriage etc. change the makeup of the Supreme Court or hell, change the structure of it. Why don’t we have 21 judges serving 10 year terms? Any given case might get a random 7 or 15 judge case. Why have we stopped imagining a better structure? Why do we settle for a 6-3 Supreme Court full of ideologues where we know the outcome of every case before they’re even debated?

I've always assumed the supreme court justices have very good security. They are frequently making decisions that are unpopular with some segment of the population. Also, it would always just be generally tempting to off one that is of the opposite party than teh sitting President so that the seat can be filled "your" team.

Highly doubt it was a justice, but likely one of the clerks or someone else who had access to documents as an editor or copywriter.

Lastly, the SC should not have lifetime appointments.

As an outsider looking at your country what i see is something that is totally broken, in a systemic way. The country is almost ungovernable, power is far too decentralised, some will say that creates freedom and local autonomy, I would counter that it removes responsibility. Plus too many people are elected to too many positions, too often. Makes them open to corruption and coercion from corporations and lobby groups. I'm waving at you the NRA. The disturbing thing for me is how we do what we can to follow your **** ups and implement them here.

Why wouldn't it be a hostile Justice? Everyone is partisan, the Supreme court has been hijacked by this ruling for 35 plus years.

Not saying it's not, just wouldn't be my guess. If it were a justice regardless of whom it is, they should be disbarred and replaced as they broke the very tenet of the court whether they're name is Alito, Sotomayor, etc.

Where was it that recently a woman was prosecuted for having a miscarriage? Pakistan? Saudi Arabia? Texas?

Honestly it could have been anyone and nobody will talk. Could have been a republican judge or politician, bit of red meat for the base. You know what will fix things over there? Red or Blue introduce them to this;
