She drew and fired without issuing a warning? Was there a confrontation?

Well it's just the 2nd day of trial, not all the details are out yet.

But yeah apparently the furniture was set up differently. But then again I think you need to take into account tunnel vision. Her being startled by a man being in what she thought was her apartment.

Apparently she said 21 times on the 911 call "I thought i was in my apartment".

You don't just shoot a man without warning him or threatening him to get out of (what you think is) your apartment. You say, "You're in my apartment. I'm armed and I'll shoot if you don't leave now."

You're allowed to use force (even deadly force) to protect yourself in your own home?

If she truly thought she was in her own home - was she not in the right to view him as a threat (i.e., an intruder) and defend herself?

I moved to a new apartment in the same complex. A couple of days after moving in, I walked into the apartment next door as it was the same configuration as my old apartment. I instantaneously realized this was not my apartment as the interior decor looked nothing like mine. And I did not ever entertain the idea that the two startled people in the room were intruders. It was a split second realization on my part that I was wrong.

A cop likely has heightened danger awareness than I do, but I cannot see how anyone can justify what she did.
