And it isn't to say that the lower tier would be a slap on the wrist, just that it would not be as life altering as a DUI.

Yes. The lower tier was actually called "DUI", standing for "driving under the influence" and the higher tier was called "DWI", meaning "driving while intoxicated". I don't recall the details but it was something like 3 DUI = 1 DWI = your license gets taken away. And I don't recall the border between the two tiers.

I just wish we treated other offenses the same. Someone texting on their phone is a much worse driver than someone driving at .05. They should also have their license taken away and given very expensive fines. Same goes with speeding, talking on your phone, and any distracted driving.

    This.

And it would be a HUGE moneymaker and over time, help save thousands of lives.

I wonder if they don’t do it as often because it’s sort of imposssibe to prove.

Drunk driving can be “proven” via breathalyzers and such.

    Speeding by radar guns.

Cell phone usage by...a cop’s sight and word? I’m not sure how consistently that would hold up.

And yes I’m aware that thousands of people are ticketed for it now.

Cell phone use could be proven by getting the call logs from the provider.

I realize that but I’m not sure cell phone providers would consent to give those. It sets a precedent.

And perhaps it’s already been set. I honestly don’t know. But I doubt for just a simple ticket.

This reminds me of something that happened here in NJ 1.5 years ago. Or maybe it was 2.5.

Basically a superintendent for a certain school district (a very good one) was running on the shoulder of the road in the morning. Perhaps he was biking. I forget. Simultaneously, a student, who was running late to get to school for a field trip for which the busses were leaving at like 6am, was driving and texting her friends that she was on her way and running late.

She hit the superintendent and killed him. Awful. Supposedly the man was beloved, a regular at church, a pillar in the community. The kid wasn’t a bad kid. At all. She made a mistake that most of us make. And lives were destroyed. This happened in Robbinsville, NJ if one cares to read about it.

I thought .08 was fairly restrictive. Guess not.

Yeah. At some point in time it becomes too expensive for the gain.

I don’t drink often so I don’t buy more than a 6-pack at once. Next on my buy list is kiitos coconut stout.
