But If penises are allowed in women's bathrooms and I go into one and start peeping at women and get caught then I simply say that I wasn't peeping and the accuser was mistaken and I feel like I'm being discriminated against and attacked as a transgender person and I didn't do anything wrong.
Then everyone apologizes to me and I get to do it some more.

Gender identity doesn't work as "I think I'll be a woman today and a man tomorrow." Any research into said individual would reveal him to be a fraud pretty much immediately.

But the authorities might be reluctant to do any research into the individual for fear that they get in trouble for discrimination/being insensitive and getting sued.

Who would dare say that they don't believe that someone is transgender and that they are faking? They would just have to take the person's word that they are in the women's bathroom legitimately.

Too risky to call someone out as a fraud. What if that person wasn't a fraud? Now the one doing the calling out would be in big trouble.

You don't know what goes on in women's bathrooms in a bar with drugs and alcohol flowing I guess. Not all bathrooms in all locations and all situations are used the same.

No it's not a hypothetical. I have partied a lot. I know women at bars who have gone into a bathroom with their friends and changed clothes with them. I had a girlfriend who spilled a drink on herself and had some extra clothes in her car and went into the bathroom and changed. Not in the stall (stalls were taken)

If you really think that at every restroom women simply go into it and go into a stall and potty and then leave and the only possible way to see some skin is to look under a stall wall then I think you are a bit naive.

But this isn't even an issue. As JazzGal said, random public bathrooms(which is what you're talking about Fish) have always been used in the way we're talking about. People go into wherever they feel they belong. There are no penis checks either way. As much as that freaks you out, it happens all the time. You've likely been in a bathroom with someone who was born biologically female and you had no idea. The issue is workplaces or schools or similar settings. Where everyone knows you and you cannot go into a bathroom without people knowing who you are and what gender you are/identify with. Those are the places you hear about and that's what laws are aimed at. So you can use whichever bathroom you feel comfortable with and not get fired/expelled/whatever for it.

And no, I really don't think it's very likely that Joe Perv from accounting will start publicly identifying as a woman and coming to work in drag just so he can check out Sally from HR in the bathroom.
