I think he would take the 5 mil if he thought he could actually win Skylar back. The reason he made Jesse stay for dinner is because he knew something would happen with Skylar to show Jesse all he has left is the "empire." Skylar also obviously doesn't really care about money, she'd rather just live with her children in peace and quiet.
