And it would be better for a kid to be with a decent gay couple than with an abusive mother and/or father.
It would still be better for a kid to be with their birth parents if those parents truly loved them and cared for them as parents should than with a gay couple no matter how decent of people they are.

Based upon the 14th Amendment - Equal Protection. Personally, I don't really understand why this should be anyone's business let alone a political issue.

I do believe it is a choice. If God is against it, then I don't think God makes a person a certain way, and then commands that person to not do it. God wasn't terribly forgiving with Sodom and Gomorrah (here comes the religion hate)
But it is also a question with many facets.

Why choose to be miserable? A lot of people are miserable. Not because they chose to be miserable, but because they made bad choices in life and now suffer the consequences.

Seriously, your post made me laugh. Did you chose to like girls? I don't believe little kids have the knowledge or understanding to make a choice about what they are attracted to. One day usually at a very young age your specific appendage comes to attention when it views an attractive girl. There is no choice it simply who you are. The choice comes when you decide to have sex. Not what gender you are naturally attracted to. Besides the fact there are plenty of "screw-ups" at birth if you believe GOD has some control of how people are. Why are people born blind, birth defects etc? Why would god do that if he doesn't make mistakes?

I love when religious people use Sodom and Gomorrah as a reason why we better watch out. God is going to fry gays or sinful people. I recall the story (not that I believe it) had more to do with the unchristian like behavior of the city inhabitants which including judging others, not helping people and many other things. Christians use it as justification to bash Gays.

Why are you assuming that all gays are miserable? I know several gay people and they are some of the most balanced people I know. I highly doubt sexual orientation has little to do with happiness. Why are you so concerned about what Gays do? And Heterosexuals are miserable. Why the high rate of Prozac in Utah?

It is obvious that you don't like people "hating on your religion". So what is wrong with people dissing your religious beliefs (for many people who think religion is ridiculous) or what is wrong with us making laws against you practicing it. I am sure you would whine all day if people didn't allow you to go to church on Sunday. Many people find your religion immoral and against God's teaching. It is a choice. No one made you choose religion. Let's get a Proposition going to get rid of Mormons.

You are entitled to your opinions just like everyone else. However, you have no right to take away someone 's rights either. This is why the law found prop 8 unconstitutional. Funny how conservatives talked about the constitution only when it fits their ideas. There have been a lot of votes that have been found unconstitutional that is why we have the Court system. See the world would be better if you just believed what you do and live your life the way you want and allow the same for others. All the other stuff is just your opinion which is based in believe and not fact.

It is probably a mix of choice and environmental factors as to if you "like girls" or boys for that matter. It may take just a kiss for a boy that likes a girl to "come to attention" as you put it, but an older man that has been watching porn and other extreme sex junk would take a whole lot more than a kiss for him to "come to attention". There is a whole lot more to this than, "it's genetic". Do you have a father figure? Who is this father figure, how does he treat women, how does he treat you, do you have a mother figure, who is she and how does she treat you, do you look to them as an example, do you have it in your mind to be nothing like them.... there are tons of factors that affect who each individual is and that includes "sexual preference".

As to why people are born blind and why God would do that if he doesn't make mistakes. Understanding things like that is a step by step process of first understanding who God is, what are his attributes, and all of that. Then understanding why humans are on the earth and what we have to do or learn while here. Understanding those things gets our feet on the path to understanding your questions, but it is also not an answer that is as simple as yes, no, or because.

As to the court system. It is as flawed, or more flawed than citizens voting on whether something is constitutional or not. The constitution is for the people and by the people. If the people say something is constitutional or not, then it is what they say. A judge, or a few judges will have just as subjective of an opinion but the decision will lie with a few, rather than with many. Sometimes checks and balances take away a bad decision and turn it into a good one, sometimes they take away a good decision and turn it into a bad one. My main though is "for the people and by the people".
 
Face it guys, all gays are miserable, unlike the rest of us...
